1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of
Quizera, including the website, applications,
assessment tools, AI-assisted quiz generation, billing features, and related services
offered through quizera.ai.
By accessing or using Quizera, creating an
account, taking an assessment, purchasing GC,
or using any part of the Service, you agree to these Terms. If you do not agree,
do not use the Service.
2. What Quizera Provides
Quizera is a quiz and assessment platform.
The Service allows users to create quizzes, use AI-assisted quiz generation, organize
quizzes into assessments, share assessments by code, link, or QR code, collect attempts,
review results, and use reporting or print-ready tools where available.
Quizera provides software infrastructure.
We are not a school, university, employer, employment agency, testing authority,
certification provider, proctoring service, legal advisor, or compliance advisor.
Users are responsible for how they create, administer, interpret, and rely on assessments.
3. Accounts and Eligibility
You are responsible for maintaining accurate account information, keeping your login
credentials secure, and all activity that occurs under your account.
Quizera is a general-audience service and is
not directed to children under 13. If a school, teacher, parent, organization, or other
user makes the Service available to students or minors, that user is responsible for
obtaining any required permissions, providing appropriate supervision, and complying
with applicable laws and policies.
Account holders may also take assessments. Some assessments may be public and available
without an account; others may require authentication or access through an audience list
controlled by the assessment creator.
4. Assessments, Participants, and Results
Assessment creators control the quizzes they create, the assessments they publish, the
access mode they choose, and how they use assessment results. Assessments may be public,
authenticated, or audience-only.
Public assessment participants may be able to take an assessment without creating an
account. Where enabled, participants may voluntarily provide a name and email address
for identification. Information provided by participants may be associated with their
attempt and visible to the assessment creator.
Assessment creators are responsible for how they collect, use, disclose, store, export,
print, or otherwise process participant information and assessment results outside of
Quizera. This includes responsibility for
educational, school, employment, hiring, privacy, consent, recordkeeping, and compliance
obligations that apply to their use.
The Service may include results, analytics, print-ready reports, answer keys, participant
snapshots, assessment attempt history, and related tools. These tools are provided to
help users operate their own workflows, but users remain responsible for maintaining
copies or records that are important to them.
5. AI-Assisted Features
Quizera may provide AI-assisted quiz generation
or related AI features. AI-generated content may be inaccurate, incomplete, biased,
misleading, inappropriate, outdated, or unsuitable for your intended use.
You are responsible for reviewing, editing, validating, and approving all AI-generated
questions, answers, explanations, prompts, and related content before using them in a
live assessment or relying on them for any purpose.
We do not guarantee that AI-generated content is correct, fair, compliant, appropriate
for students, appropriate for candidates, suitable for hiring decisions, or fit for any
educational, professional, legal, or business purpose.
6. User Content and Ownership
You are responsible for the prompts, quizzes, questions, answers, assessment names,
descriptions, audience records, participant-facing materials, and other content you
submit, create, upload, generate, or manage through the Service (“User Content”).
As between you and Quizera, you retain any
rights you have in your User Content. You grant Quizera a non-exclusive, worldwide license to host, store, copy, process, display, transmit,
generate, analyze, and otherwise use User Content as needed to operate, secure, improve,
support, and provide the Service.
You represent that you have the rights and permissions necessary to submit and use your
User Content through the Service and that your use of the Service will not violate the
rights of others or applicable law.
7. Acceptable Use
You agree not to misuse the Service. Prohibited activity includes:
- using the Service for unlawful, fraudulent, deceptive, abusive, or harmful purposes;
- sending spam, unsolicited bulk messages, or abusive assessment invitations;
- attempting to bypass rate limits, payment systems, access controls, or security measures;
- uploading or creating malicious code, malware, phishing content, or deceptive content;
- harassing, threatening, impersonating, or abusing others;
- violating intellectual property, privacy, publicity, or other rights;
- using assessments in a discriminatory or unlawful hiring, employment, school, or organizational process;
- scraping, reverse engineering, overloading, or interfering with the Service;
- using AI features to generate unlawful, abusive, or policy-violating content.
We may investigate suspected violations and take action where reasonably necessary,
including limiting features, disabling assessments, suspending accounts, removing
content, or terminating access.
8. Billing, Subscriptions, and Payments
Paid features may include Quizera Pro subscriptions,
active assessment capacity add-ons, GC purchases, or other paid offerings. Prices, features, limits, and billing terms may
change over time.
Payments are processed by third-party payment providers such as Stripe. By purchasing
paid features, you authorize the applicable charges, taxes, recurring subscription fees,
renewal charges, usage-related charges, or other amounts shown during checkout.
Subscriptions renew automatically unless canceled before the renewal date. Canceling a
subscription stops future renewal charges but may not immediately remove access before
the end of the current billing period, unless otherwise stated in the product flow.
Digital purchases are generally final. Refunds are not guaranteed and may be issued at
our discretion, where required by law, or in cases such as duplicate charges, billing
errors, technical failures, fraud investigation, or other exceptional circumstances.
9. Generation Credits
Generation Credits (“GC”)
are used for AI-assisted generation features. GC are not money, have no cash value, are non-transferable, and may not be sold, exchanged,
withdrawn, or transferred between accounts.
GC purchases are generally final and
non-refundable except where required by law or approved by Quizera.
We may revoke or adjust GC for fraud,
chargebacks, abuse, technical errors, mistaken credits, or violation of these Terms.
Quizera Pro may include a monthly
GC refill. Unless otherwise stated,
this refill brings an eligible account balance up to the stated refill target; it is
not necessarily an additional grant of that number of credits each month.
10. Records, Data Retention, and Account Closure
The Service may store account information, quizzes, assessments, participant attempts,
scores, timing, answer selections, audience records, billing activity, security logs,
email events, analytics, and related operational records.
You may request account closure or deletion by contacting us. Because
Quizera supports assessment history, billing
records, fraud prevention, participant integrity, and other users’ legitimate records,
we may retain certain information as needed for legal, security, billing, operational,
compliance, dispute-resolution, audit, backup, or platform-integrity purposes.
We may deactivate, anonymize, delete, or retain information depending on the type of
data, the reason for the request, legal requirements, technical limitations, and the
legitimate needs of the Service or other users.
11. Suspension and Termination
We may suspend, restrict, or terminate access to the Service where reasonably necessary
to protect the Service, users, participants, creators, or others, including if we
believe you violated these Terms, created risk for the Service or other users, engaged
in fraud or abuse, caused payment issues, violated applicable law, or used the Service
in a harmful way.
If access is suspended or terminated, assessments may be disabled, subscriptions may be
canceled, and unused GC may be revoked
or forfeited, especially in cases involving fraud, abuse, chargebacks, or violations of
these Terms.
12. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by
law, Quizera disclaims all warranties, whether
express, implied, statutory, or otherwise, including warranties of merchantability,
fitness for a particular purpose, title, non-infringement, availability, accuracy, and
reliability.
While we use reasonable efforts to maintain reliability and availability, we do not
guarantee that the Service will be uninterrupted, secure, error-free, free of data loss,
free of cheating, free of unauthorized access, or suitable for your particular school,
hiring, business, legal, compliance, or recordkeeping needs.
You are responsible for maintaining your own backups, exports, printed records, PDFs,
or other copies of important quizzes, assessments, attempts, results, reports, and
business records.
13. Limitation of Liability
To the maximum extent permitted by law, Quizera will not be liable for indirect, incidental, special, consequential, exemplary, or
punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, lost
data, assessment errors, AI-generated errors, participant disputes, cheating, hiring
outcomes, educational outcomes, service interruptions, or business interruption.
To the maximum extent permitted by law, our total liability for any claim related to
the Service will not exceed the amount you paid to Quizera for the Service during the three months before the event giving rise to the claim, or
$100 if you have not paid us during that period.
14. Indemnification
You agree to defend, indemnify, and hold harmless Quizera from and against claims, damages, liabilities, losses, costs, and expenses, including
reasonable attorneys’ fees, arising from or related to your User Content, assessments,
participant data handling, use of results, hiring or school workflows, violation of
these Terms, violation of law, or infringement of third-party rights.
15. Changes to the Service or Terms
Quizera is still evolving. We may modify,
suspend, discontinue, rename, reprice, or limit features, plans, pricing, assessment
limits, AI systems, GC systems,
analytics, or other parts of the Service at any time.
We may update these Terms from time to time. If changes are material, we may provide
notice through the Service, by email, or by other reasonable means. Continued use of
the Service after updated Terms become effective means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of
California and the
United States, without regard to conflict
of law principles.
